1. GENERAL DISCLAIMER
By engaging Yakima Shine Co, LLC (“the Company,” “we,” “our,” or “us”) for any detailing, ceramic coating, paint protection film (PPF), paint correction, interior restoration, or related automotive care service, the client (“you” or “client”) acknowledges and agrees to the terms, conditions, limitations, and disclaimers set forth in this document. This disclaimer applies to all services rendered by the Company, whether performed at our facility, a mobile location, or any other site.
This document does not constitute legal advice and is intended solely to inform clients of the Company’s policies, limitations of liability, and service expectations. Clients are encouraged to seek independent legal counsel if they have questions regarding any provision herein.
2. ASSUMPTION OF RISK & PRE-EXISTING CONDITIONS
Yakima Shine Co, LLC exercises the highest standard of care when handling all vehicles. However, detailing services inherently involve physical contact with a vehicle’s surfaces, and certain pre-existing conditions may become more visible or may be affected during the detailing process. By authorizing services, the client acknowledges and assumes the risk associated with, but not limited to, the following:

Pre-existing paint defects including swirl marks, scratches, oxidation, clear coat failure, chips, or peeling that may become more apparent after washing, decontamination, or paint correction.

Aftermarket modifications such as wraps, tinting, decals, plasti-dip, non-OEM paint, or aftermarket clear bra that may react unpredictably to cleaning agents or mechanical processes.

Prior body work, touch-up paint, or repainting of panels that may not withstand standard correction or polishing procedures.
-
Worn, cracked, or deteriorated trim, rubber seals, moldings, emblems, and antenna components that may loosen or detach during routine washing or dressing.

Interior materials including leather, vinyl, suede, Alcantara, and fabric that are already compromised by age, sun damage, staining, or wear.

Mechanical or electrical components (e.g., power windows, locks, convertible tops, sensors) that are in a state of partial failure and may be triggered during service.
3. LIMITATION OF LIABILITY
To the maximum extent permitted by the laws of the State of Washington, Yakima Shine Co, LLC, its owners, members, managers, employees, agents, contractors, and affiliates shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the services provided, including but not limited to:

Damage to pre-existing conditions as described in Section 2 above.

Any cosmetic changes in appearance that result from the proper removal of contaminants, waxes, sealants, or coatings that previously masked imperfections.

Loss of use, loss of profit, diminution of value, or any other economic loss resulting from claimed damage.

Damage caused by undisclosed prior repairs, aftermarket installations, or concealed defects.
In no event shall the total aggregate liability of the Company for all claims related to a single service appointment exceed the total amount paid by the client for that specific service.
4. VEHICLE INSPECTION & DOCUMENTATION
The Company reserves the right to perform a pre-service inspection of all vehicles and to document pre-existing damage, defects, or conditions through photography, video, or written notation. Clients will be advised of any notable conditions discovered during inspection. By leaving a vehicle in the Company’s care, the client consents to this inspection and documentation process.
Clients are strongly encouraged to disclose all known issues, prior repairs, aftermarket modifications, and areas of concern before service begins. Failure to disclose relevant information may limit or waive any claims against the Company related to such undisclosed conditions.
5. CERAMIC COATINGS, PPF & PROTECTIVE TREATMENTS
Ceramic coatings, paint protection films, and other protective treatments are applied according to manufacturer specifications and industry best practices. The client acknowledges and agrees to the following:

Coatings and films are not a guarantee against all damage. They do not make a vehicle scratch-proof, chip-proof, or impervious to environmental hazards, chemical etching, bird droppings, tree sap, or UV degradation.

Product warranties, if any, are provided by the product manufacturer and are subject to the manufacturer’s terms and conditions. Yakima Shine Co, LLC does not independently warrant third-party products beyond the scope of proper application.

Coating and film longevity and performance depend on proper client maintenance, including adherence to recommended wash methods, avoidance of automated car washes, and compliance with any care instructions provided.

Curing times, environmental conditions, and surface preparation requirements must be followed. The Company is not liable for coating or film failure caused by client actions during the curing period.
6. PERSONAL PROPERTY & VEHICLE CONTENTS
The Company is not responsible for personal property left inside or on the vehicle, including but not limited to electronics, cash, jewelry, documents, firearms, tools, aftermarket accessories, or any other items of value. Clients are advised to remove all personal belongings and valuables from the vehicle prior to service. Any items found during service will be set aside and returned; however, the Company assumes no liability for loss, theft, or damage to personal property.
7. PAYMENT TERMS & CANCELLATION POLICY
Payment is due in full upon completion of services unless otherwise arranged in writing. The Company accepts forms of payment as specified at the time of booking. Deposits, when required, are non-refundable unless the Company cancels the appointment. Clients who cancel with less than 24 hours’ notice or fail to appear for a scheduled appointment may be subject to a cancellation fee equal to the deposit amount or a percentage of the quoted service price, as determined by the Company.
The Company reserves the right to cease work and demand payment for services already rendered if the client becomes uncooperative, abusive, or violates the terms of this agreement.
8. INDEMNIFICATION
The client agrees to indemnify, defend, and hold harmless Yakima Shine Co, LLC, its members, managers, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) the client’s breach of any term in this disclaimer; (b) the client’s failure to disclose pre-existing conditions or modifications; (c) any third-party claims related to the vehicle or services performed; or (d) the client’s negligence or willful misconduct.
9. DISPUTE RESOLUTION & GOVERNING LAW
This disclaimer and any disputes arising from or relating to the services provided by Yakima Shine Co, LLC shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any claim or dispute shall first be submitted to good-faith mediation in Yakima County, Washington. If mediation fails, the parties agree to submit to binding arbitration in Yakima County, Washington, in accordance with the rules of the American Arbitration Association. The prevailing party in any arbitration or litigation shall be entitled to recover its reasonable attorney’s fees and costs.
The client waives any right to participate in a class action lawsuit or class-wide arbitration against the Company.
10. WAIVER & RELEASE OF LIABILITY
By authorizing any service, the client voluntarily waives, releases, and forever discharges Yakima Shine Co, LLC, its owners, members, managers, employees, agents, and contractors from any and all claims, demands, causes of action, or liability of any kind, whether known or unknown, arising out of or in connection with the services provided, except in cases of gross negligence or willful misconduct by the Company.
11. FORCE MAJEURE
The Company shall not be liable for any delay or failure to perform services due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, extreme weather, pandemics, government actions, supply chain disruptions, equipment failure, power outages, or other unforeseeable events.
12. MODIFICATION, SEVERABILITY & ENTIRE AGREEMENT
The Company reserves the right to modify, update, or amend this disclaimer at any time without prior notice. The most current version will be made available to clients upon request and at the time of service. If any provision of this disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
This disclaimer, together with any signed service agreement or work order, constitutes the entire agreement between the client and Yakima Shine Co, LLC with respect to the subject matter herein and supersedes all prior or contemporaneous oral or written communications, representations, or agreements.
13. CONSENT TO PHOTOGRAPHY & MARKETING USE
Unless the client opts out in writing prior to the commencement of service, the client grants Yakima Shine Co, LLC a non-exclusive, royalty-free, perpetual license to photograph, video record, and use images of the client’s vehicle for marketing, advertising, social media, portfolio, and promotional purposes. No personally identifiable information, including license plate numbers, will be published without the client’s explicit written consent.
14. ENVIRONMENTAL & REGULATORY COMPLIANCE
Yakima Shine Co, LLC complies with all applicable local, state, and federal environmental regulations regarding water usage, chemical disposal, and waste management. Clients are advised that water reclamation practices, biodegradable products, and responsible chemical handling are integral to our operations.
